These Terms & Conditions (“Terms”) govern all access to and use of Sands Art Gallery (“the Gallery”), its exhibitions, services, website, digital content, and all sales or consignment activities involving artworks. By visiting, purchasing, consigning, or engaging with the Gallery in any capacity, you agree to be bound by the following Terms.

  1. GENERAL TERMS OF USE
    • Access to the Gallery’s physical and digital spaces constitutes acceptance of these Terms.
    • Visitors agree to conduct themselves respectfully and in accordance with Gallery policies and staff instructions.
    • The Gallery reserves the right to deny entry or refuse service to anyone violating safety, conduct, or legal guidelines.
  1. DEFINITIONS
    • “Gallery” refers to Sands Art Gallery and its representatives.
    • “Artist” refers to any creator exhibiting or selling artworks through the Gallery.
    • “Collector/Client” refers to any buyer or potential buyer of artwork.
    • “Artwork” refers to any creative work displayed, consigned, or sold through the Gallery.
    • “COA” refers to the Certificate of Authenticity issued by the Gallery.
  1. INTELLECTUAL PROPERTY
    • All artworks, images, branding, texts, and digital materials are protected by copyright law.
    • The Collector receives no reproduction rights.
    • Visitors and clients may not reproduce, download, modify, or distribute artwork images without written permission.
    • The Gallery may photograph exhibitions and artworks for documentation, marketing, and archival purposes unless otherwise agreed with the Artist.
  1. ARTIST RIGHTS
    • Artists retain full copyright and moral rights to their artworks unless otherwise contractually transferred.
    • Artists have the right to:
      • Receive proper credit for their work.
      • Expect professional display, handling, and promotion of their artworks.
      • Receive payment according to signed consignment or sales agreements.
      • Artists will be notified before the Gallery undertakes conservation, framing changes, or any form of modification.
    • Unsold artworks remain the property of the Artist and must be returned in the same condition in which they were delivered, normal wear and professional handling excepted.
    • The Gallery will represent the artwork fairly, honestly, and with respect for the Artist’s reputation and market position.
  1. GALLERY RIGHTS
    • The Gallery reserves the right to curate, select, or decline artworks at its sole discretion.
    • Sands may determine exhibition layout, display methods, lighting, and promotional strategies.
    • The Gallery may adjust pricing in consultation with the Artist to ensure market consistency.
    • The Gallery may reject any collector or sale that appears fraudulent, ethically questionable, or harmful to the Artist’s market.
    • The Gallery may collect and use visitor and collector data as described in the Privacy Policy.
    • The Gallery may refuse entry to individuals who pose a risk to artworks, visitors, or staff.
    • The Gallery may reproduce images of the Artwork for documentation, promotion (that may include printed catalogues among other similar usage, press, and archival purposes.
  1. TERMS OF SALE (INCLUDING PREVIOUSLY AGREED CONDITIONS)
    • Purchase Confirmation
      • Sales are considered final once payment is completed unless otherwise stated in these Terms.
      • Every purchased artwork includes:
        • A Certificate of Authenticity (COA) indicating the artwork code, certificate number, artist’s name, artwork details, and date of purchase.
        • Relevant documentation and provenance materials, if applicable.
      • Condition & Inspection (Previously Agreed Clause)
        • The Collector acknowledges that the artwork is sold as seen during in-gallery viewing or through images provided by the Gallery.
        • If the artwork is shipped to the Collector, the following protocol applies:
      • Upon delivery, the Collector is granted 30 minutes of inspection time at the delivery location.
      • A Gallery representative must be present during this inspection.
      • The Collector may decide on the spot to keep or return the artwork.
      • If returned under this clause, the artwork must be handed back immediately to the Gallery’s representative.
      • A full refund will be issued within 3 working days, provided the artwork is returned in the same delivered condition.
  • Payment Terms
    • The Gallery accepts cash, bank transfers, certified methods, and selected digital payment options.
    • All prices are stated in Egyptian Pounds (EGP) unless otherwise specified.
    • International buyers are responsible for currency conversion costs, duties, and import taxes.
  • Shipping & Delivery
    • The Gallery offers local shipping, handled by approved logistics partners.
    • Shipping costs, insurance, customs duties, and taxes (if applicable) are borne by the Collector.
    • The Gallery ensures professional packing and handling but is not liable for third-party shipping delays.
  • Returns & Refunds

Except for the inspection clause above, all sales are final. No returns or cancellations are permitted after the artwork leaves the inspection window.

  1. COMMISSIONS & CONSIGNMENT (IF APPLICABLE)
    • The Gallery may accept commissions or consigned artworks under separate written agreements.
    • Commission deposits are non-refundable unless the Gallery terminates the commission.
    • Consignment agreements include detailed terms regarding duration, pricing, commissions, and return conditions.
  1. VISITOR CONDUCT & RESPONSIBILITY
    • Visitors must refrain from touching artworks unless explicitly invited.
    • Children must be supervised at all times.
    • Babies up to 5 years of age are not allowed
    • Any damage caused by a visitor is the responsibility of the visitor and may incur repair or replacement costs.
  1. WEBSITE TERMS
    • The website is for personal, non-commercial use only.
    • The Gallery is not responsible for downtime, technical errors, or external links.
    • Online content is subject to change without notice.
  1. PRIVACY POLICY
    • The Gallery collects basic visitor, artist, and client information for service, security, and communication purposes.
    • Data will never be sold or shared with unauthorized third parties.
    • Sensitive information (payment data, passport copies, etc.) is handled under strict confidentiality.
  1. LIABILITY DISCLAIMER
    • The Gallery is not responsible for personal injury, loss, or damage except where required by Egyptian law.
    • The Gallery is not liable for any indirect or consequential damages arising from Gallery services, exhibitions, or transactions.
    • Artwork valuations are provided as guidance and are not guaranteed for future resale value.
  1. GOVERNING LAW

These Terms are governed by the laws of the Arab Republic of Egypt. Any disputes shall be resolved through Egyptian courts unless both parties agree to arbitration.

  1. AMENDMENTS

The Gallery may update these Terms periodically. Continued use of the Gallery or its website implies acceptance of the revised terms.
